These Terms & Conditions (“Terms”) apply to the website and digital products operated and provided by SHINE FLOW S.R.O. (“Shine Flow”, “we”, “us” or “our”), a company registered in Slovakia.
They apply to your purchase and use of the IN MOTION fitness program.

By purchasing or accessing IN MOTION, you confirm that you have read and understood these Terms and agree to be bound by them.
If you are purchasing IN MOTION as a consumer, nothing in these Terms affects any mandatory consumer rights that apply to you under applicable law.
IN MOTION is a digital fitness program designed primarily for women who want to build strength, improve movement, and develop a strong, shaped and athletic body.
The program is a 6-week digital training program and includes digital materials such as:
IN MOTION is a digital product. No physical goods are shipped and no physical delivery is involved.
IN MOTION is intended for general fitness and educational purposes only. It does not provide individual medical, physiotherapy, nutritional or personal training advice.
IN MOTION is offered as a one-time purchase of €49.
The price displayed at the time you place your order is the price applicable to that purchase.
We reserve the right to change the price of IN MOTION at any time. Any price change will not affect an order that has already been completed.
Payments are processed securely by Stripe, our third-party payment service provider.
Stripe processes your payment information in accordance with its own terms and privacy practices. Shine Flow does not store your full payment card details.
By completing your purchase, you authorise the applicable payment provider to charge your selected payment method for the amount shown at checkout.
IN MOTION is delivered digitally.
After successful payment, you will receive access to the program through the method described on the website, which may include access to a member area, downloadable materials, video content and/or access instructions sent to your email address.
You are responsible for providing a valid email address and for ensuring that you can receive our emails.
You are also responsible for having a suitable device, internet connection and any software reasonably required to access the digital content.
If you experience a technical problem accessing the program, please contact us at michaela.holbovaa@gmail.com and we will make reasonable efforts to help you access the content.
Your purchase gives you a personal, limited, non-exclusive and non-transferable licence to access and use IN MOTION for your own personal, non-commercial purposes.
Your purchase does not transfer ownership of any of the program's content or intellectual property to you.
Your access is intended for you personally and may not be shared with another person.
You agree that you will not, and will not permit anyone else to:
If you breach these Terms, we may suspend or terminate your access to IN MOTION without further notice, subject to your mandatory legal rights.
We reserve the right to take further action where appropriate to protect our intellectual property.
All content provided as part of IN MOTION, including but not limited to the program structure, PDF materials, videos, photographs, graphics, written materials, exercise descriptions, branding, logos and design, is owned by or licensed to Shine Flow and is protected by applicable copyright and other intellectual property laws.
All rights not expressly granted to you under these Terms are reserved.
You may use the materials only for your own personal use in accordance with these Terms.
IN MOTION is intended for general fitness and educational purposes. It is not medical advice and is not a substitute for professional medical advice, diagnosis or treatment.
Before beginning a new exercise program, you should consider whether exercise is appropriate for you and, where appropriate, consult a qualified healthcare professional.
This is particularly important if you are pregnant or recently gave birth, have an injury or medical condition, experience pain or other symptoms during exercise, or take medication that may affect your ability to exercise safely.
You are responsible for exercising within your own abilities and for selecting appropriate weights, resistance, intensity and exercise modifications.
Always use appropriate equipment and exercise in a safe environment.
Stop exercising and seek appropriate medical attention if you experience significant pain, dizziness, fainting, chest pain, unusual shortness of breath or other concerning symptoms.

Your results may depend on factors including your starting point, training consistency, effort, nutrition, sleep, recovery, genetics and lifestyle.
We do not guarantee any particular fitness, strength, body-composition or aesthetic result.
Testimonials, photographs or examples shown on our website represent individual experiences and should not be understood as a guarantee that you will achieve the same results.
IN MOTION is designed to be adaptable to different fitness levels and lifestyles.
You are encouraged to modify exercises where appropriate and to choose an appropriate weight, resistance, intensity and range of motion for your current ability.
You are responsible for progressing at a pace that is appropriate for you.
In addition to any statutory consumer rights you may have, Shine Flow offers a voluntary 14-day money-back guarantee for IN MOTION.
If you decide within 14 days of purchase that IN MOTION is not right for you, you may contact us at michaela.holbovaa@gmail.com to request a refund.
The refund will be processed in accordance with our Refund Policy.
This voluntary guarantee does not limit or replace any mandatory consumer rights you may have under applicable law.
If you purchase IN MOTION as a consumer in the European Union, you may have statutory rights under applicable consumer protection and digital-content legislation.
Nothing in these Terms is intended to exclude, restrict or replace any mandatory consumer rights that cannot legally be excluded or restricted.
Where applicable law provides you with rights that are more favourable than these Terms, those statutory rights will continue to apply.
IN MOTION consists of digital content that may be made available to you immediately after purchase.
Where applicable law provides a statutory right of withdrawal, you may have a 14-day withdrawal period for an online purchase. However, EU consumer rules provide an exception for certain contracts involving digital content that is not supplied on a tangible medium once performance has begun, provided that the consumer has given the required prior express consent to begin performance and acknowledged the resulting loss of the right of withdrawal, and the trader has provided the required confirmation.
Accordingly, where required, the checkout process will ask you to provide your express consent to immediate access to the digital content and to acknowledge the applicable consequences for your statutory right of withdrawal.
Any voluntary 14-day money-back guarantee offered by Shine Flow is separate from and does not reduce any mandatory rights you may have under applicable law.
To the maximum extent permitted by applicable law, Shine Flow will not be liable for indirect, incidental, special or consequential loss arising from your use of IN MOTION.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit us to exclude or limit.
Where liability may legally be limited, Shine Flow's total liability arising from your purchase or use of IN MOTION will not exceed the amount you paid for the program.
We may update, improve or modify the content of IN MOTION from time to time.
We may also update these Terms when necessary, including to reflect changes in the program, applicable law or our services.
The version of these Terms applicable to your purchase is the version presented to you at the time of purchase, subject to any mandatory legal requirements.
If we make changes after your purchase, those changes will not remove or reduce any mandatory rights you already have.
These Terms are governed by the laws of the Slovak Republic, without prejudice to any mandatory consumer protection rights that apply to you under the law of your country of residence.
Where applicable law permits the parties to choose the competent courts, disputes will be subject to the jurisdiction of the competent courts of Slovakia.
Nothing in this section prevents a consumer from relying on mandatory rights or bringing proceedings in a court that is available to them under applicable consumer protection law.
